Issued by Fort Comfort Gutters LLC, doing business as Fort Comfort Drywall ("Fort Comfort Drywall," "we," "us," "our"), a division of Fort Comfort Services. The warranty period runs from the date of substantial completion of your project.
Transferable Limited Warranty on Workmanship
Drywall work performed by Fort Comfort Drywall is warranted against defects in workmanship for a period of two (2) years from the date of substantial completion. During this period, if the work fails to meet the finish level specified for your project because of how it was installed or finished, we will bring the workmanship up to our professional standards at no cost to you.
Covered workmanship defects include:
- blistered, lifting, or separating tape;
- cracking at joints, corners, or corner bead caused by improper taping or finishing;
- trowel and knife marks, ridging, or excessive pitting in the finished surface;
- fasteners that were improperly set or that break the finished surface because of improper fastening;
- loose or protruding corner bead;
- texture defects and finish inconsistencies outside the tolerance of the specified finish level;
- board that was hung out of plane, out of square, or with improper joint layout.
One-time settlement touch-up
New framing and new construction move as the structure dries and settles. Within the first twelve (12) months after substantial completion, on drywall we installed, we will return one time to touch up fastener pops and seam cracks that result from normal shrinkage and settlement, even though those are not defects in our workmanship. This is a single visit and is separate from the warranty repairs described above.
How defects are evaluated
Finished drywall is evaluated against the level of finish specified for your project, using industry standards including the Gypsum Association GA-214 recommended levels of finish.
A defect must be visible under normal lighting conditions, from a normal viewing position of not less than six (6) feet from the surface. Raking light, handheld work lights held against the wall, and other artificial light directed along the surface are not the standard by which the work is judged, unless a Level 5 finish was specified and paid for in your signed agreement.
A small number of minor hairline cracks and fastener pops is normal in Colorado homes and is addressed under the one-time settlement touch-up above rather than as a workmanship defect.
Texture matching and paint
On repair, patch, and texture-matching work, we match the existing surface as closely as the material, texture, and aging of that surface allow. Hand-applied texture and weathered paint vary, and an exact match to an existing finish is not guaranteed and is not a covered defect.
Warranty repairs include priming the repaired area. Final painting, repainting to a break line, and any wallpaper, trim, or other finish applied over our work are the homeowner's responsibility unless painting was included in your signed agreement.
Transfer
This warranty may be transferred one time to a subsequent owner of the home if the home is sold during the two-year period. To transfer it, the new owner must notify us in writing at hello@fortcomfortdrywall.com within thirty (30) days of the sale. The warranty then continues for the remainder of the original two-year term only and does not restart.
Manufacturer product warranty (separate)
The gypsum board, joint compound, tape, corner bead, fasteners, and any other materials installed on your project carry the warranty provided by their manufacturer (for example, USG, National Gypsum, Georgia-Pacific, or CertainTeed). Those manufacturer product warranties are separate from this workmanship warranty, are provided directly by the manufacturer according to their own terms, and cover defects in the product itself, such as sagging, warping, or paper delamination caused by a manufacturing flaw. If you have a product issue, we will help you connect with the manufacturer to make a claim.
General limitations and exclusions
This warranty does not cover:
- Structural movement, foundation settlement or heave, expansive soil movement, and truss uplift, and any cracking or separation that results from them, beyond the one-time settlement touch-up described above.
- Damage from water in any form, including roof leaks, plumbing leaks, gutter or drainage failure, ice dams, flooding, condensation, and excessive or uncontrolled indoor humidity.
- Repairs we performed where the underlying source of water or damage was not corrected before or after our work.
- Acts of God (for example, hail, high winds, tornadoes, flood, freezing), acts of war, fire, stress resulting from localized heat, and vandalism.
- Impact damage, abuse, negligence, normal wear and tear, and damage caused by other trades, occupants, or pets.
- Defects caused by framing, substrate, insulation, or rough-in conditions that we did not install, and by materials or board supplied or installed by the homeowner or by others.
- Work performed on our drywall by anyone other than Fort Comfort Drywall or a contractor we authorize, and any finishing, painting, or other material applied to or adjacent to our work after we completed it.
- In unconditioned or unheated spaces, including garages that are not heated and conditioned, cracking and fastener movement caused by temperature and humidity cycling. Defects in how the board was hung and finished remain covered in those spaces.
- Color, sheen, and texture variance between repaired areas and surrounding weathered or previously painted surfaces.
- The materials themselves, which are covered by the manufacturer product warranty described above rather than by this workmanship warranty.
- Any work for which payment has not been made in full under your signed agreement.
How to make a claim
Contact us within the warranty period at (303) 578-5399 or hello@fortcomfortdrywall.com and describe the issue. Photos of the area help us respond faster. We may schedule an inspection to confirm the cause. If the issue is covered, we will correct the workmanship as described above and schedule the repair at a mutually agreeable time. Seasonal conditions and drying time may affect scheduling.
Limitations
This is a limited warranty. To the fullest extent permitted by law, our sole obligation is to correct covered workmanship, and we are not liable for any incidental, consequential, or other damages. This warranty does not affect the separate manufacturer product warranties, is part of and subject to your signed agreement with Fort Comfort Drywall, and is governed by the laws of the State of Colorado.
